This Privacy Policy explains how AVGAN SERVICES PRIVATE LIMITED ("AVGAN", "Gshilp", "we", "us") collects, uses, stores, protects, shares and deletes information. We are committed to compliance with India's Digital Personal Data Protection Act, 2023 (DPDP Act), with Meta's Platform Terms and Developer Policies where we process WhatsApp data, and, where applicable, with Amazon's Data Protection Policy.

2. What we collect

Enquiry data you give via our contact form, WhatsApp, phone or email: name, phone number, email, business name and your service requirement.

KYC and business documents provided to obtain a service (GST registration, VPOB/APOB): PAN, Aadhaar or other government ID, photograph, address proof, bank proof, and for companies or firms the Certificate of Incorporation, MOA/AOA, board resolution, authorised-signatory letter or partnership deed.

Website and technical data: basic log data such as IP address and browser type, and cookies used to operate the site.

3. WhatsApp Business messaging services

Where a client engages us to operate WhatsApp Business messaging on their behalf, AVGAN acts as a service provider to that client and processes data only on their instructions and for their stated purpose.

What we process

The client's WhatsApp Business Account details and business phone number; message content and metadata exchanged between the client and their own customers; the customer's WhatsApp phone number and profile name; delivery and read status; and the message templates the client uses.

Where it comes from

This data is received from Meta Platforms, Inc. through the WhatsApp Business Platform (Cloud API), under Meta's Platform Terms and Developer Policies, and from the client's own WhatsApp Business app where the client has enabled Coexistence.

Why we process it

Solely to deliver the messaging service the client has asked us to run — sending order, shipment, compliance and service notifications; routing and answering incoming customer messages; and reporting on delivery to the client.

What we do not do

We do not use client or end-customer message data for our own purposes, for another client's purposes, to build advertising profiles, or to train models. We do not sell it, and we do not share it for anyone else's marketing.

Consent

We send business-initiated WhatsApp messages only where the client confirms the recipient has opted in, as required by Meta's Business Messaging Policy. We do not send unsolicited or bulk messages.

Retention and deletion

Message data is retained only while the client's engagement is active and for any period required by law, after which it is deleted. A client may request deletion at any time by writing to anand@gandhishilp.com; we will delete within 30 days unless retention is legally required.

End-customer rights

Any WhatsApp user who has messaged a client's business number may write to anand@gandhishilp.com to access or delete their data. Where the client is the decision-maker, we will pass the request to them and support them in answering it.

Where it is stored

WhatsApp message data is stored with India selected as the data-residency region, and on servers we control. Access is restricted to authorised personnel on a need-to-know basis.

4. Why we use your information

To respond to your enquiry; to prepare and file GST registration, VPOB and APOB applications and amendments; to represent you before the GST department; to deliver messaging services you have engaged us for; and to issue invoices and meet legal, tax and regulatory obligations. We do not sell your data or use it for unrelated marketing.

5. How we share it

We share information only as needed to deliver the service — principally with the Goods and Services Tax authorities and government portals, with Meta Platforms and our authorised WhatsApp Business Solution Provider for message delivery, and with professional partners such as a chartered accountant strictly to perform the service. We may disclose information where required by law. Any partner we share with is required to protect it to standards at least as strict as our own.

6. How we store and protect it

Documents are stored securely with access restricted to authorised personnel on a need-to-know basis, with reasonable technical and organisational safeguards. Sensitive documents are handled only for the stated purpose.

7. How long we keep it

We keep information for as long as needed for the purpose collected and for any statutory retention period. When no longer required, it is deleted or securely destroyed.

8. Your rights under the DPDP Act

You may request access to, correction of, or deletion of your personal data; withdraw consent; and nominate another person to exercise your rights. Write to anand@gandhishilp.com and we will respond within a reasonable period. If you are dissatisfied, you may complain to the Data Protection Board of India.

9. Cookies

This site uses only cookies necessary to operate it. We do not use advertising or cross-site tracking cookies.

10. Children

Our services are for businesses. We do not knowingly collect the personal data of children.

11. Changes

We may update this Policy. The version published here is the version that applies, and the date above shows when it last changed.
